1. INTRODUCTION AND ACCEPTANCE
Welcome to MAGIXX ART ("Company," "we," "us," or "our"), a company registered in Germany at Lange Str. 14, Dannenberg 29451.
We operate the website https://magixx.art (the "Site") and provide online retail services for physical products (collectively, the "Services"). We sell and ship exclusively to customers located in the United States, Canada, United Kingdom, and Australia.
By creating an account or placing an order, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
We may update these Terms or modify, suspend, or discontinue any part of the Services at any time. We will notify you of material changes via email or by posting a notice on our Site. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
The Services are intended for users who are at least 18 years old or the age of majority in your jurisdiction, whichever is greater.

2. ACCOUNT REGISTRATION

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or incomplete, or if you violate these Terms.
3. PRODUCTS AND PRICING
We strive to display product colors, features, and specifications as accurately as possible. However, the actual appearance of products may vary slightly due to differences in device displays.
All products offered on our Site are custom items featuring exclusively our own designs. Each product is individually produced upon order placement.
Not all products are available in every country. Product availability depends on the production location. Available shipping destinations are displayed on each product page.
All products are subject to availability. We reserve the right to discontinue products or change prices at any time without prior notice. All prices displayed on our Site are inclusive of applicable taxes. Shipping is currently free. However, we reserve the right to introduce shipping fees at any time, in which case applicable costs will be displayed at checkout.
If we discover an error in the price of a product you have ordered, we will contact you to inform you of the error and give you the option to continue with the corrected price or cancel your order.
4. ORDERS AND PAYMENT
When you place an order, you are making an offer to purchase products subject to these Terms. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including product unavailability, pricing errors, or suspected fraud.
Payment is processed through PayPal. By providing your payment information, you confirm that you are authorized to use the selected payment method. Payment is due at the time of order.
You will receive an order confirmation email upon placing your order. Acceptance occurs when we dispatch your order and send you a shipping confirmation.
5. SHIPPING AND DELIVERY
We ship to addresses in the United States, Canada, United Kingdom, and Australia only. Orders with shipping addresses outside these countries will not be processed.
Shipping is currently free for all orders. We reserve the right to introduce shipping fees in the future, in which case costs will be displayed at checkout prior to purchase. Estimated delivery times are shown at checkout but are not guaranteed. Delays may occur due to carrier issues, customs processing, weather, or other factors beyond our control.
Risk of loss and title for products pass to you upon delivery to the carrier. You are responsible for providing accurate shipping information. We are not liable for orders shipped to incorrect addresses that you provided.

6. RETURN AND REFUND POLICY
ALL SALES ARE FINAL. All products in our store are custom items individually produced upon order placement. We do not accept returns or provide refunds.
Damaged or Defective Products
The only exception applies if a product arrives damaged, defective, or materially different from its description. In that case, please contact us within 7 days of delivery via our Return & Exchange Portal and include photos of the issue. After review, we may offer a replacement or refund at our discretion.

7. PRODUCT REVIEWS
Our Site allows registered customers to submit reviews, ratings, photos, and videos of purchased products ("Reviews"). By submitting a Review, you agree that:
• Your Review is truthful, accurate, and reflects your honest opinion of a product you purchased.
• Your Review does not contain false, misleading, defamatory, obscene, offensive, or discriminatory content.
• Your Review does not infringe on the intellectual property, privacy, or other rights of any third party.
• Any photos or videos you submit are your own original content.
By submitting a Review, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, display, and distribute your Review in connection with our Services and marketing efforts.
We reserve the right to remove, edit, or reject any Review that violates these Terms or that we deem inappropriate, without notice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIXX ART AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM, OR €100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. If these laws apply to you, some of the above exclusions or limitations may not apply, and you may have additional rights under local law.
13. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of Germany, without regard to conflict of law principles.
For customers in the United States, Canada, United Kingdom, or Australia, mandatory consumer protection laws of your jurisdiction may also apply to the extent they provide greater protection than German law.
In the event of a dispute, we encourage you to first contact us at support@magixx.art to seek an informal resolution. If we cannot resolve the dispute informally within 30 days, either party may pursue formal proceedings.
Any legal proceedings shall be brought in the competent courts of Germany, unless mandatory consumer protection laws in your jurisdiction require otherwise.
14. TERM AND TERMINATION
These Terms remain in effect while you use our Services or maintain an account with us.
We may suspend or terminate your account and access to the Services at any time, with or without cause or notice. Reasons for termination may include violation of these Terms, suspected fraudulent activity, or extended periods of inactivity.
You may terminate your account at any time by contacting us at support@magixx.art. Upon termination, your right to use the Services will immediately cease. Termination does not affect any rights or obligations that accrued prior to termination.
15. GENERAL PROVISIONS
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MAGIXX ART regarding your use of the Services and supersede any prior agreements. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
